This Mimi Weisinger course identifies and explains 10 of the most common sources of lawsuits filed against real estate licensees: fraud, breach of duty, breach of contract, negligence, bodily injury, negligent misrepresentation regarding the property condition, consumer fraud, earnest/escrow money disputes, misrepresentation regarding flooding or leaks, and misrepresentation regarding the value of the property. Each will be discussed and most illustrated using legal case summaries (most found on realtor.org). Specific ways the agents can minimize their risk will be identified. Proper use of the NJ DCA Seller Property Disclosure and handling stigmatized properties will also be discussed.

The ten most common claims against agents (e.g., breach of fiduciary duty, negligent misrepresentation, consumer fraud, etc.) are identified and discussed in class.  Case studies are examined and specific ways agents can minimize their risk are identified.  The proper use and value of the NJ DCA Seller Property Disclosure is also explored.
